    Hello,

    Today my application for a British citizenship has been approved. So happy about that
    My Algerian husband has been been in the UK for 4 years. he has got his residence card and presettlement status.
    So to apply for British citizenship does he need follow original way (5 yrs presettelment +1 yr settlement) or can he apply for it as a spouse of a British citizen obviously once I get my certificate (3 yrs pre settlement)??

      Everyone needs to have settled status, the only difference is that those who are married to a British citizen at the time the application is made, do not need to wait 12 months to apply.

      Why you still need at least 5 years' residence

      If married to a UK national, then you only need to meet the following criteria to apply:
      1. Have been in the UK lawfully for at least 3 years
      2. Be settled in the UK (having PR, ILR or Settled Status)
      3. Meet the other conditions such as absences, good character, language and LITUK.
      So, you may well meet 1) and 3) after three years, but until you have PR, ILR or Settled Status, you are not considered 'settled'.

      The British Nationality Act was passed in 1983, when it was still possible to settle in less than five years, hence the three year requirement, however, these days virtually all routes to settlement take at least five years.

      To apply on these basis, you need to be married to, or in a civil partnership with, your British spouse or civil partner at the time the application is made

      There is no requirement to have been married or in a civil partnership for a certain period of time, nor for the British citizen to have been British for a period of time (in cases where British citizenship was acquired by registration or naturalisation).

      People who obtain their citizenship through naturalisation are not officially British until the day of their ceremony, when the certificate of naturalisation is handed to them.
