  • Buying a property

    My husband and I are in the process of buying a property in the UK. Both of us have pre settle status (we will apply for settle status in January).
    our solicitor asked us to provide with proof of the right to live and work in the UK. We sent a copy of our Italian passport and pre settle status. They found these document not sufficient in the caee of my husband who works for an US based international company and they asked for a letter from his employment confirming his right to live and work in the uk (odd!). They replied asking to confirm if my husband and I have the intention to remain in the UK and renew your pre settled status after March 2024. I found this question quite out of the blue .. do you have any idea why they would ask it? Is that somehow related to brexit? Better to specify that the purchase does not involve any mortgage. Thanks for your help!

    Assume this solicitor is a conveyancing specialist, in fact, these days it's not necessary to be a solicitor to work on conveyancing. Whatever their qualifications, they have been grossly misinformed, since EU nationals have the right to live and work in the UK just by being EU nationals, and all that's required is proof of EU citizenship. This will be the case until the end of 2020 in the event of no deal (later if there is a deal), as noted here: UKCEN Citizenship and Residence for European Nationals and their families

    You may want to send your solicitor a link to that document.

    The passport would have been enough, there's no requirement to have status till 2021.

    Is your husband also an EU national? If not, then it would be appropriate to ask this question, and having pre-settled status would show he has such a right. International companies wouldn't hire someone without the right to work in the UK, as they can be fined up to £20,000.

    Yes, ignorance and lack of knowledge of the law.

    If it did, it would be the lender asking rather than the conveyancer.

    Furthermore, if there's no mortgage involved, then it is even possible for people without the right to live and work in the UK, to purchase property in the UK, as can be seen by the number of foreign investors (i.e. investors who don't live, nor have any intention to live in, the UK) who own property in the UK.
